NYS Requirements for Harassment Prevention Training
New York State requires all employers to provide sexual harassment prevention training to all employees, regardless of size or employment classification:
Training must include:
- An explanation of sexual harassment as a form of unlawful discrimination
- Examples of sexual harassment
- Information about reporting procedures and legal rights
- Information about the internal complaint process
- Information about the complaint process available through the New York State Division of Human Rights, the New York City Commission on Human Rights, and the Equal Employment Opportunity Commission
- Information about retaliation and how it’s prohibited
- Information about the responsibilities of supervisors and managers
- Information about bystander intervention
Training must be provided in the primary language of the employees. If the employer doesn’t have a template in the employee’s primary language, they can provide an English-language version.
Training must be interactive, and employees should be able to provide feedback.
Employers can use the model training developed by the Department of Labor and Division of Human Rights, or they can ensure their training meets or exceeds the minimum standards. Model training materials are available to download.
